As per the most recent figures from IIMEDIA Marketing consultant Group, China had a home mobile Internet market that amounted to about 10.8 billion Yuan in the Q3 of 2012 and that the mobile games provided to 10.3% of that amount. However, it also pointed out that of this 10.3% only 1.4 % of the games used there were legitimate editions.

Hong Tao, the founder of the company called Taole Technology in Shenzhen that develops games said that there were two issues that were a hindrance to the creation of mobile phone games. The first was group buying, where many companies got together to create the same type of games and the other was piracy. He stated that irrespective of who developed a novel mobile phone game and irrespective of whether the game was attractive or not, it could be found for free downloading on the Internet.

He also stated that a well known and preferred mobile phone game did not usually offer much profit for its creators as it would soon be copied by other makers of games, such that the players will wonder which the authentic version is.

The major reason that game developers hesitate to go in for litigation is because of the expenses and also the low amount awarded even if they happen to win the case.

IT columnist Zhang Shupin stated that the majority of mobile game developers do not have high financial capabilities and moreover it was difficult to find each of the people who infringe on their games. He also stated that lawsuits take longer than the life of a game in the market, so winning a case does not help as they would be losing out on all the profit that they could make.

As a result the games developers simply have to pay no heed to privacy, instead of which they should try competing with them for the lion's share.

An IT law expert and chief advisor at chinaweblaw.com, Zhao Zhanling stated that his country requires many typically powerful cases to create an awareness of intellectual property rights between mobile game creators. In added that they copyright officials should also reinforce their power of enforcement.

IIMEDIA stated that it was essential that the mobile phone application market should better their rules and testing systems to ensure that the rights of game developers are secure. It also advised that the companies developing games should create other means to expand sources of profit.
